common sense, culture, experience, religion and language etc determine what is a lie or not.

experience:
A class mate of mine in my secondary school days once told me that his father said "when you lie, you have to cover that one lie up with many more lies and you keep getting deeper until you are like a drowning person at sea" He continued saying...."When you tell the truth you can be offered a bargain for your freedom or reduced jail sentence, even if you were an armed robber captured by the police"

Common sense:
If you have a hired killer in front of you just shoot somebody whom they asked to say "im a bastard" but that person refused. Now when it gets to your turn you better say "im a bastard , in fact im even a bitch! you may end up making the killer laugh.

Language
The english language has many meanings for the same thing unlike most other languages for example "because, reason, intention" all mean the same thing. The english language can be twisted and used in a political setting for example you can say " i will see you later" or you can say " i will see you at 2pm toady" .."I will see you later could mean i willl see you in 10 years , however "i will see you at 2pm today is definite" some laguages only have one way to say one thing.
